Welcome to the Montana BLM
I call this file "tidbits", updated 01/15/2006
As a Whistle Blower, I help keep BLM mgrs in Montana "honest"
just my way of saying "Thanks!" (see start.html for details)
If it wasn't for folks like former BLM DSD Janet Singer, you probably wouldn't be here...
Look for more "tidbits" in 2005; and until the US Department of the Interior puts its'
Montana Dakotas BLM house in order, revealing bits of insider information
will continue to become public knowledge.
*Due to the continual increase in this record
I have curtailed this file to more recent "tidbits"
and in other areas of the web pages I will be archieving
items such as previous smt calendars and the 1998 Employee
Survey slides for example; if you need something that is
archieved -- just email me for a copy
For all previous "tidbit" entries (such as Ethics violations
Funds Diversions, Discrimination, Articles written by former BLM'ers
etc.)

Welcome to 2005! and the Battle for Truth and Justice continues...

A recent email Reply from Congressman Denny Rehberg
"I am committed to ensuring the solvency of our Social Security system,
and am an original cosponsor of the Social Security and Medicare Lock-Box Act,
which passed the House in the 107th Congress.
The bill will prevent the surpluses of the Social Security and Medicare
hospital insurance trust funds from being used for any purpose
other than providing retirement and health security.
The Lock-Box Act also requires that such surpluses be used to pay down the national debt
until such time as Medicare and Social Security reform legislation is enacted."

When the Russians had "secret" police, it was a bad thing...
"The names of the law enforcement personnel have been removed from these documents.
Exemption 7(C) of the FOIA similarly protects law enforcement records where disclosure
“. . . could reasonably be expected to constitute an unwarranted invasion of personal privacy.”
Withholding the names of law enforcement personnel is in line with several court decisions where the
identities of law enforcement personnel were exempt from disclosure.
The harm in releasing this information is that members of the public could use this information to harass
these officials in the conduct of their official duties and in their private lives."

What former BLM managers do...
Dave Mari of Lewistown, Montana, was the lucky Grand Prize winner!
FedEx® delivered an early Christmas gift for Dave Mari!
He was the big winner in the Hampton® Get Out and Play sweepstakes!
The original prize was a convertible, but Dave chose the $30,000 cash option.
(We think it might have had something to do with the snowy Montana winters.)
In an unusual coincidence, he was actually heading to a Hampton Inn® to celebrate
a friend's going away party when he received the news!
As soon as Dave arrived at the hotel, he spoke with the General Manager,
our own Dustan Williams, to confirm that it was the real deal.
Indeed it was . . . 100% official!
Dave often stayed with the Hampton hotel brand while on business trips.
While traveling, he was a frequent guest at the Hampton Inn in Billings, Great Falls,
and Helena, Montana. Since his retirement last July, he still stays with the Hampton
hotel brand for his personal travel.
So what's he going to do with all that money?
"We might take a big trip or invest the money. And we'd definitely like to be able
to give a little to our children too."
Congratulations, Dave! Have fun spending (or saving) your winnings!
US Attorney files response to my appeal, pretty much makes my argument for me...
note that 99% of the time, the Agency (Solicitor/US Attorney) will wait until their
due date, as in the above instance, and then request an extension(which is routinely rubberstamped/approved).

"We have the greatest opportunity the world has ever seen, as long as we remain honest
-- which will be as long as we can keep the attention of our people alive.
If they once become inattentive to public affairs, you and I,
and Congress and Assemblies, judges and governors would all become wolves." --Thomas Jefferson.
"I often wonder whether we do not rest our hopes too much upon
constitutions, upon laws and upon courts. These are false hopes, believe me,
these are false hopes. Liberty lies in the hearts of men and women;
when it dies there, no constitution, no law, no court can save it;
no constitution, no law, no court can even do much to help it.
While it lies there, it needs no constitution, no law, no court to save it.">--Judge Learned Hand
"You may think the Constitution is your security -- it is nothing but a piece of paper.
You may think that the statutes are your security --they are nothing but words in a book.
You may think the elaborate mechanism of government is your security --
it is nothing at all unless you have sound and uncorrupted public opinion
to give life to your Constitution, to give vitality to your statutes, to make efficient your machinery."--Justice Charles Evans Hughes
"Good intentions will always be pleaded for every assumption of authority.
It is hardly too strong to say that the Constitution was made to guard the people against
the dangers of good intentions.
There are men in all ages who mean to govern well, but they mean to govern.
They promise to be good masters, but they mean to be masters."--Daniel Webster

Chicago Sun Times Chief judge calls for more security March 17, 2005
BY NATASHA KORECKI Federal Courts Reporter
Calling the Feb. 28 Lefkow family slayings an "assault on the law," Chicago's chief federal judge
said Wednesday all judges now need to try to anticipate how litigants will react to their rulings.
In a State of the Courts address before the Federal Bar Association in Chicago,
Chief Judge Charles Kocoras singled out those people who file their cases pro se,or without an attorney.
"It is no longer going to be enough to determine the correct legal answers to a myriad of disputes;
it will often be necessary, especially with pro se litigants,
to attempt to divine how they may receive our rulings," he said.
Kocoras' comments came after admitted gunman Bart Ross killed the husband and mother of U.S. District Judge Joan Lefkow
in her North Side home after she ruled against Ross in his medical malpractice lawsuit.
Ross killed himself near Milwaukee last week and left a suicide note confessing to the murders.
Kocoras called for increased security measures for judges,
adding some jurors might feel unsafe deliberating certain cases.

There will come soft rains and the smell of the ground,
And swallows circling with their shimmering sound;
And frogs in the pools singing at night,
And wild plum trees in tremulous white;
Robins will wear their feathery fire,
Whistling their whims on a low fence-wire;
And not one will know of the war, not one
Will care at last when it is done,
Not one would mind, neither bird nor tree,
If mankind perished utterly;
And Spring herself, when she woke at dawn
Would scarcely know that we were gone.

Latest News from Class Action case... before the 9th Circuit for over a year now...
the Court has affirmed Interior/BLM's Right to Practice Discrimination(age & sex discrimination, race and gender discrimination in hiring)
and the dismissal of the case by the Montana Court;
by denying me the right as Class Agent to represent the class of present and future employees,
in effect, an Agency circumvents discrimination laws by removing an employee,
their status then as a non-employee limits the "protections" ;>) from discrimination
and the Agency is free to continue to discriminate, to destroy careers, to do personnel "business as usual"
My purpose is to make this information public knowledge and I have done so (and will continue to do so).
This example gives credence to the "Bright Shining Lie" that is America

Whistleblower Protection Voted Down
Rep. Edward J. Markey, D-Mass., announced he would introduce legislation to provide all
federal employees, contractors and private sector workers who report homeland or national security flaws,
threats to public health and safety, violations of laws, or waste, fraud and mismanagement with improved
whistleblower protections. An amendment version of Markey's legislation has already failed on a vote at a
markup of the Homeland Security Authorization Act.
Under Markey's bill, if the Department of Labor fails to act on a whistleblower's case within six months,
he or she would have the right to bring a case in civil court, and if successful, be entitled to compensatory
and punitive damages. For more on this story, see the May 9, 2005, issue of Federal Employees News Digest.

Why Lee Atwater apologized when he was dying in 1991-- he wrote in LIFE Magazine
Lee Atwater's strongest regret was about the mean spirit of the Republican era he helped create.
"My illness helped me to see that was missing in society is what was missing in me: a little heart,
a little brotherhood.... The 80's were about acquiring -- acquiring wealth, power, prestige.
I know. I acquired more wealth, power and prestige than most.
But you can acquire all you want and and still feel empty....
It took a deadly ilness to put me eye to eye with that truth, but it is a truth that the country,
caught up in its ruthless ambitions and moral decay, can learn on my dime.
I don't know who will lead us through [it], but they must be made to speak to this spiritual
vacuum at the heart of American society, this tumor of the soul."
"Lee Atwater's Last Campaign, "LIFE (February 1991).
“….agents, servants of a Government and a society whose existence and strength comes from…..constitutional safeguards,
are serving law when they respect, not override these (constitutional) guarantees.
The claim and exercise of a constitutional right cannot thus be converted into a crime”,
the federal court opinioned in Miller v. U.S. 230 F2d.486 at 289.
“There can be no sanction or penalty imposed upon one because of his exercise of Constitutional rights”,
it was held in Sherar v. Cullen 481 F2d 946.
"We are fast approaching the stage of the ultimate inversion: the stage where the government
is free to do anything it pleases, while the citizens may act only by permission; which is the
stage of the darkest periods of human history, the stage of rule by brute force." [Ayn Rand, The Nature of Government]
"What is clear is that this is the practice in the Orwellian world of the 'dinosaur' Interior Department,"
it said. "Tell the truth -- get punished. Tell a lie -- win a promotion, receive accolades and lucrative bonuses."
The chief information officer for the Bureau of Land Management has told a federal judge that Interior Department officials
retaliated against her after she testified about her efforts to decertify some of her agency's computer systems as unsafe from hackers.

Welcome to Amerika!
The Ninth Circuit Court of Appeals this month affirmed it's decision to allow Interior and the BLM
to practice discrimination: Interior's policy of discrimination in the form of race and gender preferences in hiring can continue
and the practice of age and sex discrimination against white males (over 40) - as documented against BLM Montana managers is evidently moot.
The Courts argument to the Class Action filing - if an employer removes an employee, the former employee no longer
has standing to bring any class action discrimination claims to court - even if the former employee files the class action
EEOC discrimination complaint while still an employee and the EEOC renders a decision that the complaint can go to court.
Guess what employers will do in the future when faced with class action discrimination complaints...
Still believe in truth, justice, and the "American" way ;>)

Federal employees and Congress members who are convicted of white collar crimes would forfeit their retirement benefits
if the Public Trust and Accountability Act is passed by Congress and signed into law.
The bill, introduced by Rep. Lee Terry, R-Neb., would amend Title 5 of the U.S. Code to strip
government employees of their retirement benefits if convicted of laws that violate the public trust
or fiduciary duties. That would include bribery, embezzlement and perjury.
Terry stated, “Without the trust of the people and accountability for actions, the government
cannot work.” Currently, Title 5 only denies benefits to individuals convicted of violating national security laws, such as treason.
